General Provisions

These conditions are valid exclusively between the company Lady M snc di Biancu Sergio, with registered office in Via N. Sauro 33, Frazione La Caletta - 08029 Siniscola (NU), VAT number 01566430912, hereinafter referred to as "LADYM' and any person who makes online purchases on the website www.ladymsardegna.com hereinafter referred to as "CUSTOMER". These terms and conditions may be subject to change and the date of their publication on the site shall be equivalent to the effective dateThese conditions govern purchases made on the www.ladymsardegna.com website, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on e-commerce.

ARTICLE 1 - Subject matter of the contract

By these general terms and conditions of sale, LADYM sells and the CUSTOMER purchases at a distance the tangible movable goods indicated and offered for sale on the website www.ladymsardegna.com. The contract is concluded exclusively via the Internet, by means of the CUSTOMER accessing www.ladymsardegna.com and placing a purchase order according to the procedure set out on the site itself.The customer undertakes to read, before confirming his order, these general terms and conditions of sale, in particular the pre-contractual information provided by LADYM, and to accept them by placing a flag in the box indicated.In the order confirmation e-mail, the CUSTOMER shall also receive a link to download and file a copy of these general terms and conditions of sale, as provided for in Article 51(1) of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

ARTICLE 2 - Pre-contractual information for the consumer - Article 49 of Legislative Decree 206/2005

Prior to the conclusion of the purchase contract, the CUSTOMER takes note of the characteristics of the goods, which are illustrated in the individual product sheets at the time of the CUSTOMER'S choice.Prior to validation of the order with "obligation to pay", the CUSTOMER is informed about - total price of the goods including taxes, with details of shipping costs and any other costs; - the method of payment; - the deadline by which LADYM undertakes to deliver the goods; - conditions, terms and procedures for exercising the right of withdrawal (art. 6 of these terms and conditions) as well as the standard withdrawal form in Annex I, part B of Legislative Decree 21/2014; - information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal; - existence of the legal guarantee of conformity for the purchased goods; - conditions of after-sales assistance and commercial guarantees provided by LADYM .The CUSTOMER may at any time, and in any case before the conclusion of the contract, become acquainted with the information relating to LADYM, its geographical address, telephone and fax numbers, e-mail address, information that is also set out below:LADYM di Biancu Sergio Via N. ARTICLE 3 - Conclusion and effectiveness of the contract

The sales contract is considered concluded when LADYM sends the CUSTOMER an e-mail confirming the order. The e-mail contains the CUSTOMER's details and order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the link to print and file a copy of these terms and conditions.The CUSTOMER undertakes to check the accuracy of the personal data contained in the above email and to promptly notify LADYM of any corrections/changes to be made.LADYM undertakes to describe and present the items sold on the website in the best possible way. Nevertheless, there may be some errors, inaccuracies or small differences between the product depicted on the site and the actual product. Furthermore, the photographs of the products presented on www.ladymsardegna.com do not constitute a contractual element, as they are to be considered representative only.LADYM undertakes to deliver the goods within 30 days starting from the sending by LADYM of the order confirmation e-mail to the CUSTOMER.

ARTICLE 4 - Availability of products

Product availability refers to actual availability at the time the CUSTOMER places the order. This availability must in any case be considered purely indicative since:- products could be sold to other CUSTOMERS before the order is confirmed, due to the simultaneous presence of several users on the site,- an IT anomaly could occur such that a product is available for purchase that is not in fact available.Even after the order confirmation e-mail sent by LADYM, partial or total unavailability of the goods may occur. In this eventuality, the order will be automatically rectified by eliminating the unavailable product or products and the CUSTOMER will be immediately informed by e-mail; with this e-mail the CUSTOMER will also be informed of the method and timeframe for the refund of any sums paid.

ARTICLE 5 - Terms of Payment

Any payment by the CUSTOMER may only be made by means of the credit cards indicated on the www.ladymsardegna.com website, by bank transfer, or by the Paypal payment method.In case of payment by Paypal, the actual charge shall be made when LADYM sends the order confirmation e-mail.Communications relating to the payment and the data communicated by the CUSTOMER when the payment is made shall take place on special protected lines.

ARTICLE 6 - Prices

All product sales prices shown on www.ladymsardegna.com are in Euro and include VAT, and where applicable, the WEEE contribution.Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before payment is made.The CUSTOMER accepts LADYM's right to change its prices at any time, however the goods shall be invoiced on the basis of the prices indicated on the website when the order is created and indicated in the confirmation e-mail sent by LADYM to the CUSTOMER.In the event of a computer, manual, technical or any other error that may result in a substantial change, not foreseen by LADYM, in the sale price to the public, making it exorbitant or clearly derisory, the purchase order shall be considered invalid and cancelled and the amount paid by the CUSTOMER shall be refunded within 14 days from the day of cancellation.

ARTICLE 7 - Right of Withdrawal

In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without penalty and without specifying a reason, within a period of 14 days from the date of receipt of the products.The CUSTOMER who intends to exercise the right of withdrawal must notify LADYM by means of an explicit declaration, which may be sent by registered letter with return receipt or by accessing the "My Orders" section of the "My Account" space on the www.ladymsardegna.com website, with the creation of a computerised Return File.The CUSTOMER may also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract.In the event of exercising the right of withdrawal, the CUSTOMER shall return the goods within 14 days from the day on which he/she communicated to LADYM his/her wish to withdraw from the contract pursuant to Article 57 of Legislative Decree 206/2005.The goods must be sent back to LADYM di Deiana Marcella, at Via Antonio Gramsci, 3, 08029 Siniscola, (NU), the shipping costs will be borne by the CUSTOMER*.The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, LADYM will refund the amount of the products subject to withdrawal within a maximum period of 14 days.As provided for by Article 56 paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, LADYM may suspend the refund until receipt of the goods or until the CUSTOMER proves that he has sent the goods back to LADYM.LADYM shall make the refund using the same means of payment chosen by the CUSTOMER at the time of purchase. In case of payment by bank transfer, and if the CUSTOMER intends to exercise his/her right of withdrawal, he/she shall provide LADYM with the bank details: IBAN, SWIFT and BIC necessary to make the refund.*It is understood that in the event of a product defect, shipping costs will be borne by LADYM.

ARTICLE 8 - Legal Guarantee of Conformity

In the event of receipt of defective products or products that do not conform to the orders placed, the CUSTOMER is entitled to have the product restored free of charge by repairing or replacing the product. The CUSTOMER may exercise this right if the defect becomes apparent within two years of delivery of the goods and reports the defect to LADYM within two months of its discovery.In order to exercise the aforementioned right, the customer must proceed to create a computerised Return file by accessing the "My orders" section of the "My online account" space on the www.ladymsardegna.com website.In the event of a defective or non-compliant product, LADYM shall, at its own expense, arrange for the withdrawal of the product, subject to the CUSTOMER's availability.

ARTICLE 9 - Legal Warranty

All products presented on www.ladymsardegna.com benefit from the legal guarantee of conformity referred to in the previous article.To benefit from the warranty service, the CUSTOMER must keep the invoice and provide a copy of itThe products shall be delivered by express courier to the address indicated by the CUSTOMER when placing the order no later than 30 days from the date of receipt by the CUSTOMER of the order confirmation e-mail sent by LADYM.For each order placed on www.ladymsardegna.com, LADYM issues an invoice for the goods shipped. The invoice is available and printable, after the order has been processed, in the "My orders" section of the CUSTOMER's "My account" space. The invoice shall contain the information provided by the CUSTOMER during the purchase process. After the invoice has been issued, it will not be possible to make any changes to the data indicated on the invoice.

ARTICLE 11 - Liability

LADYM accepts no liability for inefficiencies attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and failures of the Internet network, in the event that it is unable to execute the order within the time provided for in the contract.

ARTICLE 12 - Access to the site

The CUSTOMER has the right to access the site for consultation and making purchases. No other use, particularly commercial, of the site or its content is permitted. The integrity of the elements of this site, whether audio or visual, and the related technology used remain the property of LADYM and are protected by intellectual property law.

ARTICLE 13 - Cookies

The www.ladymsardegna.com website uses "cookies". Cookies are electronic files that record information relating to the CUSTOMER'S navigation on the site (pages consulted, date and time of consultation, etc.) and which enable LADYM to offer a personalised service to its customers.LADYM informs the CUSTOMER of the possibility of deactivating the creation of these files by accessing its Internet configuration menu. ARTICLE 14 - Integrity

These General Terms and Conditions of Sale comprise the entirety of the clauses making up these General Terms and Conditions of Sale. If one or more provisions of these General Terms and Conditions of Sale is deemed invalid or declared invalid by law, regulation or following a decision by a court having jurisdiction, the other provisions shall continue to be in full force and effect.

ARTICLE 15 - Applicable Law and Jurisdiction

These General Terms and Conditions of Sale are subject to Italian law.Any dispute that cannot be settled amicably shall be submitted to the exclusive jurisdiction of the Court of Nuoro.In any case, it is possible to optionally resort to the mediation procedures set forth in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these terms and conditions of sale by accessing the following site: https://webgate.ec.europa.eu/odr
